Can I claim my kids on 2010 taxes, the courts changed the parenting time from 50/50 to me having them 75%?

The split agreement was not re-written. I didn't think to have this changed when the court changed the parenting lifetime agreement. The original separation agreement had 1 my ex claim one kid, the me the other 2 kids for 2008, then flipped the next year.

The IRS doesn't go by the court documents.

It goes by NIGHTS. If you had them all year (or 183+ nights) and the other spouse had them less than 183 nights, you are the custodial root.

Your monetary aid isn't determined by your parents' tax refund. If you look at the FAFSA form, there's no place that asks for knowledge about tax REFUNDS. Their income and the taxes they paid (along with your income and taxes and several other factors)
